Tinubu Challenges Atiku’s Forgery Evidence
President Bola Tinubu has urged the Supreme Court to dismiss the forgery evidence presented by Atiku Abubakar, the presidential candidate of the Peoples Democratic Party (PDP) in the 2023 election.
Background: Tribunal’s Dismissal and Atiku’s Appeal
This request comes in the wake of the Presidential Election Petition Tribunal’s decision on September 6 to dismiss Atiku’s petition, in which he challenged the results of the February 25 presidential election.
The tribunal deemed Atiku’s case as lacking merit.
Atiku’s 35-Ground Appeal
Following the tribunal’s judgment, Atiku filed a 35-ground notice of appeal with the Supreme Court on September 18, asking the highest court to overturn the tribunal’s findings.
He claimed that the tribunal’s conclusions were flawed and had led to a miscarriage of justice.
Tinubu’s Argument: Questioning the Forgery Evidence
In response, President Tinubu presented a counter affidavit on October 12, contending that the Supreme Court should reject Atiku’s forgery evidence.
Tinubu’s argument revolves around the deposition of Caleb Westberg, the Registrar of the Chicago State University (CSU), who provided this evidence.
He asserts that the deposition was conducted by U.S. attorneys, not certified judicial officers, thereby raising concerns about its reliability.
Neutral Setting and Venue Selection
Tinubu also raised concerns about the setting in which the deposition took place, alleging that it was not neutral.
He pointed out that the legal firm representing Atiku, Dechert LLP, selected their West Wacker office as the deposition venue. Tinubu cited Angela Liu, Esq., counsel to Atiku, as a partner at this law office.
This legal battle continues to unfold, with both parties presenting their arguments before the Supreme Court.
